On August 3, 2026, Supernus Pharmaceuticals, Inc. (the “Company”) published a post relating to the proposed merger of equals of the Company and Indivior Pharmaceuticals Inc. (“Indivior”) on the Company’s LinkedIn account. In addition, on August 3, 2026, the Company distributed to its employees communications relating to the proposed merger, consisting of an email to Company employees from Jack A. Khattar, the Company’s President and Chief Executive Officer, and a presentation used at a Company employee meeting. Copies of the LinkedIn post, the employee email and the employee presentation are filed as Exhibit 99.1, Exhibit 99.2 and Exhibit 99.3 hereto, respectively, and are incorporated herein by reference.
